These terms apply to your use of nerocollectibles.com and to orders placed with Nero Collectibles. By using the website or placing an order, you agree to them. Nothing in these terms limits your rights under the Australian Consumer Law.

1. About us

Nero Collectibles is an Australian online retailer of Pokémon Trading Card Game products, single cards, graded cards and accessories. It is operated by a sole trader, ABN 83 428 915 761.

2. Using the website

You must use the website lawfully. You must not infringe anyone's rights, attempt unauthorised access, interfere with the website's security, submit false information, or scrape or overload the website with automated tools. We may suspend or restrict access where reasonably necessary.

3. Product information and images

We aim to keep descriptions, prices and availability accurate, but errors can occur. Colours can look different on different screens.

Images of single cards are stock images used to identify the card. They do not show the exact copy you will receive. Graded cards, and listings stated to show the actual item, are photographed individually. Sealed product images may be manufacturer or stock images, and packaging can differ.

If a material error affects your order before it is dispatched, we will contact you so you can confirm or cancel it.

4. Single cards and conditions

Single cards are sold by condition: Near Mint, Lightly Played, Moderately Played, Heavily Played or Damaged. Each condition is defined in our Refund Policy. The condition you select at checkout describes the card you will receive, and each condition is priced separately.

Listings state the card's name, set, number, language and finish. Please check these details before you buy. We do not guarantee the future market value of any card or any return on investment.

5. Graded cards

Graded cards are graded and encapsulated by the third-party grading company named in the listing. We do not control grading standards and do not guarantee that a card would receive the same grade if resubmitted.

6. Sealed products

Sealed products contain randomly assorted cards. We do not guarantee any particular card, rarity or pull rate. We do not open, weigh, search or reseal factory-sealed products.

7. Selling cards to us

We may offer to buy cards from you. Any offer we make is based on our own assessment of the cards' authenticity, condition and market value, and we may revise or withdraw an offer after inspecting the cards in person. We may decline any card.

By selling cards to us you confirm that you own them and are entitled to sell them, and that they are genuine. We may ask for identification. If you post cards to us, they remain at your risk until we receive them.

8. Prices

Prices are in Australian dollars and may change without notice. A price change does not affect an order we have already accepted. If a product is listed at an incorrect price, we may contact you to confirm the order at the correct price or cancel and refund it.

9. Orders

Placing an order is an offer to buy. An order confirmation email acknowledges your order and does not mean we have accepted it. We accept an order when we dispatch it.

We may cancel an order before dispatch if the product is unavailable, the listing or price was incorrect, payment cannot be verified, we suspect fraud, or a technical error occurred. We will refund any amount you paid for a cancelled order.

We sell some products on more than one platform. Occasionally an item sells elsewhere before our stock updates. If that happens, we will cancel the affected item and refund you in full.

10. Payment

We accept the payment methods shown at checkout. Payment must be authorised before dispatch. Payments are handled by third-party payment processors, and we do not store your full card details.

11. Shipping

Shipping is covered by our Shipping Policy.

12. Returns and refunds

Returns and refunds are covered by our Refund Policy.

13. Pre-orders

Release and dispatch dates for pre-orders are estimates and can be changed by the manufacturer or distributor. We will make reasonable efforts to tell you about material changes. Payment and cancellation terms are shown on each pre-order listing.

14. Accounts

If you create an account, keep your login details confidential and your information accurate and up to date. Tell us promptly if you suspect unauthorised use. We may suspend or close accounts involved in fraud or a serious breach of these terms.

15. Promotions and discount codes

Promotions may have their own terms. Unless stated otherwise, discount codes cannot be exchanged for cash, only one code can be used per order, discounts cannot be applied to past orders, and a minimum spend may apply. We may withdraw a promotion where reasonably necessary.

16. Intellectual property

The Nero Collectibles name, logo and original website content belong to us or our licensors and must not be copied or used commercially without our written permission.

Pokémon and all related names, characters and card images are trademarks and copyright of Nintendo, Creatures Inc., GAME FREAK inc. and The Pokémon Company. Nero Collectibles is an independent retailer and is not affiliated with, endorsed by or sponsored by any of them.

17. Reviews and other content you submit

Reviews and other content you submit must be accurate and lawful and must not be defamatory or misleading. You give us a non-exclusive, royalty-free licence to use that content for our business and promotion. We may remove content that does not comply.

18. Prohibited activities

You must not commit fraud, use stolen payment methods, manipulate promotions, create multiple accounts to avoid restrictions, abuse the refund process or exploit website vulnerabilities. We may cancel transactions and restrict accounts where we reasonably suspect this.

19. Third-party services

We use third-party providers, including Shopify, payment processors, shipping carriers, eBay, Whatnot and analytics services. Their own terms and privacy policies may apply. To the extent permitted by law, we are not responsible for how they operate.

20. Website availability

We aim to keep the website available but do not guarantee uninterrupted or error-free access. Downtime can result from maintenance, updates, technical faults, security incidents or events outside our control.

21. Limitation of liability

Nothing in these terms excludes, restricts or modifies any consumer guarantee, right or remedy that cannot be excluded under the Australian Consumer Law or any other law.

Subject to that, and to the extent permitted by law, we are not liable for indirect or consequential loss, and our liability for any claim relating to a product is limited to replacing the product or refunding the price you paid for it.

22. Privacy

We collect the personal information needed to process orders, deliver products, provide support, operate the website and prevent fraud. Our Privacy Policy explains how we handle it.

23. Changes to these terms

We may update these terms and will publish the new version with a revised date. The terms in force when you placed an order apply to that order.

24. Governing law

These terms are governed by the laws of Queensland, Australia. Disputes are subject to the courts and tribunals of Queensland, without limiting any rights you have under Australian law.
